Immigration Hardship Psychiatric Evaluations

Comprehensive Psychological Evaluations for Immigration Proceedings

Invictus Integrative Psychiatry provides independent, comprehensive psychiatric evaluations to assess psychological hardship in immigration-related cases. These evaluations are conducted with clinical rigor and documented in a clear, objective manner suitable for review by immigration attorneys, adjudicators, and the court.

Our role is not advocacy, but clinical assessment. All findings and opinions are based on thorough evaluation, collateral information when available, and accepted psychiatric standards.

What Is an Immigration Hardship Evaluation?

An immigration hardship evaluation is a formal psychiatric assessment designed to evaluate the psychological impact that separation, removal, or continued immigration-related uncertainty may have on a qualifying relative.

These evaluations may be used to support cases involving:

  • Extreme or exceptional hardship to a qualifying family member
  • Family separation or prolonged detention
  • Psychological effects on children, spouses, or dependent relatives

Each evaluation is individualized and based on the specific circumstances of the case.

Our Evaluation Process

Each immigration hardship evaluation typically includes:

  • A comprehensive clinical interview
  • Review of relevant psychosocial history
  • Assessment of emotional, behavioral, and functional impact
  • Consideration of developmental factors (when evaluating children)
  • Evaluation of current symptoms, coping capacity, and risk factors
  • Objective clinical formulation grounded in DSM-5 diagnostic criteria (when applicable)

When appropriate and available, collateral information may be incorporated to support clinical findings.

Documentation Provided

Following the evaluation, a formal written psychiatric report may be provided, which can include:

  • Clinical background and relevant history
  • Behavioral observations and symptom presentation
  • Functional and psychosocial impact
  • Diagnostic impressions (when clinically indicated)
  • Professional opinion regarding psychological hardship
  • Clear, neutral language suitable for legal review

Documentation is prepared with attention to clarity, neutrality, and professional standards.

  • Children affected by potential separation from a parent
  • Parents dependent on adult children for emotional or functional support

Each case is assessed individually to determine appropriateness.
